1. INTRODUCTION AND ACCEPTANCE

1.1 These Terms and Conditions (“Terms”) govern your registration and participation in soccer coaching classes operated by Escuela Fútbol Español (“we,” “us,” “our,” or “the Company”).

1.2 By registering for our coaching classes through our website at www.efesoccer.com/, you (“Parent/Guardian” or “you”) accept and agree to be bound by these Terms.

1.3 References to “Participant” or “Child” refer to the minor child enrolled in our coaching programs.

2. REGISTRATION AND ELIGIBILITY

2.1 All registrations must be completed by a parent or legal guardian of the Participant who is at least 18 years of age.

2.2 Participants must fall within the age ranges specified for each program:

  • Up to 2 years old
  • 2-4 years old
  • 5-10+ years old

2.3 You must provide accurate and complete information during registration, including emergency contact details and any medical conditions or special needs.

2.4 We reserve the right to refuse registration or terminate participation if eligibility requirements are not met.

3. PRICING AND PAYMENT

3.1 Pricing Structure:

  • Up to 2 Years Old: $150 per 45-minute session
  • 2-4 Years: $200 per 60-minute session
  • 5-10+ Years: From $250 per 90-minute session

3.2 Payment can be made online through our website or in person at the class.

3.3 Promotional Offers:

  • 2-4 Years: Book 10 classes, receive 1 free
  • 5-10+ Years: Receive 1 free one-on-one coaching session for every 15 classes attended (up to 45 classes)

3.4 All prices are in the local currency and are subject to change with 30 days’ notice.

3.5 Payment must be received before or at the time of the session. Late payments may result in suspension of participation.

4. CANCELLATION AND REFUND POLICY

4.1 By Parent/Guardian:

  • Cancellations must be made at least 24 hours before the scheduled session
  • Cancellations made less than 24 hours in advance are non-refundable
  • Sessions cancelled with proper notice may be rescheduled subject to availability or credited toward future sessions

4.2 By Escuela Fútbol Español:

  • We reserve the right to cancel sessions due to weather, insufficient enrollment, coach illness, or other unforeseen circumstances
  • In such cases, you will receive full credit toward a future session or a full refund at your choice
  • We will make reasonable efforts to notify you as soon as possible via WhatsApp, email, or phone

4.3 No-Show Policy:

  • Failure to attend a scheduled session without prior notice will result in forfeiture of payment for that session
  • No refunds or credits will be issued for no-shows

4.4 Refunds, when applicable, will be processed within 14 business days to the original payment method.

5. SESSION DETAILS AND CONDUCT

5.1 All sessions take place at Happy Valley Recreation Ground Football pitches unless otherwise communicated.

5.2 Daily updates on session locations and any changes will be provided through our WhatsApp groups, which parents/guardians will have access to upon registration.

5.3 Parents/guardians must ensure Participants arrive on time and are collected promptly at the end of each session.

5.4 Participants must:

  • Wear appropriate athletic attire and footwear
  • Bring water and any necessary personal items
  • Follow all instructions from coaches
  • Respect other participants, coaches, and facilities

5.5 Disruptive, dangerous, or disrespectful behavior may result in removal from the session without refund and potential termination from the program.

6. HEALTH AND SAFETY

6.1 You confirm that the Participant is in good health and physically able to participate in soccer activities.

6.2 You must disclose any medical conditions, allergies, disabilities, or special needs that may affect the Participant’s ability to participate safely.

6.3 You authorize our staff to seek emergency medical treatment for the Participant if necessary, and agree to be responsible for any medical expenses incurred.

6.4 We maintain appropriate first aid supplies and coaching staff trained in basic first aid, but we are not responsible for providing medical care beyond emergency first aid.

6.5 In case of injury or illness during a session, we will make reasonable efforts to contact you immediately.

7. ASSUMPTION OF RISK AND LIABILITY WAIVER

7.1 Acknowledgment of Risk: You acknowledge that soccer activities involve inherent risks including, but not limited to, physical injury, property damage, or even death.

7.2 Voluntary Participation: Participation is voluntary and you accept all risks associated with the Participant’s involvement.

7.3 Release of Liability: To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue Escuela Fútbol Español, its owners, coaches, employees, volunteers, and agents from any and all liability for injury, illness, death, or property damage arising from participation in our programs.

7.4 Insurance: We strongly recommend that you maintain adequate health and accident insurance covering the Participant.

7.5 This waiver does not exclude liability for gross negligence, willful misconduct, or violations of applicable law.

8.1 We may photograph or video record sessions for promotional, educational, or social media purposes.

8.2 By registering, you grant us permission to use images, videos, or testimonials featuring the Participant in our marketing materials, website, and social media channels.

8.3 If you do not consent to such use, you must notify us in writing at the time of registration.

8.4 No compensation will be provided for the use of such materials.

9. WEATHER AND FACILITY CONDITIONS

9.1 Sessions may be cancelled or relocated due to inclement weather, unsafe field conditions, or facility closures.

9.2 Decisions regarding weather-related cancellations are at the sole discretion of Escuela Fútbol Español.

9.3 You will be notified of cancellations or relocations as soon as reasonably possible through WhatsApp or other communication channels.

10. COACH QUALIFICATIONS AND RATIOS

10.1 All coaches employed by Escuela Fútbol Español are selected based on their qualifications, experience, and passion for youth development.

10.2 We maintain appropriate coach-to-participant ratios to ensure safety and effective instruction.

10.3 We reserve the right to substitute coaches as necessary without prior notice.

11. EQUIPMENT AND PERSONAL BELONGINGS

11.1 We provide basic soccer equipment for use during sessions.

11.2 Participants may bring their own equipment, but we are not responsible for loss, theft, or damage to personal items.

11.3 Clearly label all personal belongings. Unclaimed lost items will be held for 30 days before donation or disposal.

12. BEHAVIORAL EXPECTATIONS FOR PARENTS/GUARDIANS

12.1 Parents/guardians are expected to:

  • Support a positive learning environment
  • Respect coaches’ decisions and teaching methods
  • Refrain from coaching from the sidelines during sessions
  • Model good sportsmanship and respectful behavior

12.2 Abusive, threatening, or inappropriate behavior toward coaches, staff, other parents, or participants will not be tolerated and may result in termination of the Participant’s enrollment without refund.

13. COMMUNICATION AND UPDATES

13.1 Official communications will be sent via:

  • WhatsApp groups (primary method for daily updates)
  • Email (for important notifications)
  • Website announcements

13.2 You are responsible for checking communications regularly and keeping your contact information current.

14. MODIFICATIONS TO PROGRAMS

14.1 We reserve the right to modify session times, locations, coaching staff, or program structure with reasonable notice.

14.2 Significant changes will be communicated at least 7 days in advance when possible.

14.3 If modifications substantially affect your ability to participate, you may withdraw with a pro-rata refund for unused sessions.

15. TERMINATION

15.1 By Parent/Guardian: You may terminate enrollment at any time with written notice. Refunds for prepaid sessions will be provided on a pro-rata basis, minus a $50 administrative fee.

15.2 By Escuela Fútbol Español: We may terminate a Participant’s enrollment for:

  • Repeated behavioral issues
  • Non-payment
  • Provision of false information
  • Breach of these Terms
  • Safety concerns

15.3 No refunds will be provided for terminations due to breach of Terms.

16. DATA PROTECTION AND PRIVACY

16.1 We collect and process personal information in accordance with applicable data protection laws.

16.2 Information collected includes contact details, medical information, and emergency contacts, and will be used solely for program administration and safety purposes.

16.3 We will not share your information with third parties except as required by law or in case of emergency.

16.4 You have the right to access, correct, or request deletion of your personal data by contacting us.

17. INTELLECTUAL PROPERTY

17.1 All materials, coaching methods, logos, and content associated with Escuela Fútbol Español are our intellectual property.

17.2 You may not reproduce, distribute, or commercially exploit any of our materials without written permission.

18. INDEMNIFICATION

18.1 You agree to indemnify and hold harmless Escuela Fútbol Español from any claims, damages, or expenses arising from:

  • The Participant’s conduct during sessions
  • Your breach of these Terms
  • Any false or misleading information provided during registration

19. GOVERNING LAW AND DISPUTE RESOLUTION
